Wetzel, J., at hearing, jury trial, sentencing and resentencing), rendered November 15, 2004, as amended May 23, 2005, convicting defendant of criminal possession of a controlled substance in the first degree and unlawful possession of marijuana, and sentencing him, as a second felony drug offender, to an aggregate term of 12 years, unanimously affirmed.
