GRAVES, Judge.

Appellant was charged with the murder with malice of T. EShofner, and upon his conviction he was given the death penalty, and he appeals.

*23Mrs. T. E. Shofner, wife of the deceased, was an employee of the Southern Pacific Railroad as a telegrapher-clerk. Her office was out on South Main Street in Houston, Texas, and her hours of work were from 6:00 p. m. until 2:00 o’clock a. m., at which last hour she was relieved by her father.
