RALPH G. THOMPSON, District Judge.

The above entitled cause comes before the Court upon defendant’s Motion to Dismiss. The plaintiffs have brought this cause of action for damages to their growing crops, a fence, and a levy, that allegedly resulted from the negligence of the defendant and its servants, agents, and employees. Plaintiffs allege that said damages resulted from defendant’s failure to take precautions against flooding in the construction work related to the Waurika Dam and Res ervoir Project.
