This is an action of tort brought by the plaintiff by her father as next friend to recover compensation for an assault alleged to have been committed on her by the defendant. There was evidence tending to show that the defendant committed the assault upon the plaintiff. The defendant offered in evidence a sealed instrument signed by the plaintiff releasing the defendant from all claims and demands, and also the record of a case on the criminal side of a district court wherein it appeared that the plaintiff had caused a complaint for assault upon her to be made against the defendant, that the…
