The main question in this case is, should the *458writing in controversy have been submitted to the jury to determine whether or not it is the will of Collins E. Patterson, deceased.
It consists of six different items written with a lead pencil, under the date of January 12th 1871, on the last four pages of the decedent’s memorandum-book entitled “Merchant’s Account Book and Buyer’s Guide,” found the next day after he died, in his private drawer, in a desk belonging to the plaintiff, David M.
