This case was submitted to the judge without a jury, upon stipulation of facts, together with testimony which is uneo-ntradieted. I find the material facts in response to special requests to be as follows:
The petitioner is a citizen of Georgia, resident in this district, and the defendant a citizen of Georgia, resident in this district, having been, since December 5, 192Í, collector of internal revenue for the district of Georgia.
