Order unanimously modified on the law and as modified affirmed without costs in accordance with the following Memorandum: This action arises from the purchase of residential property by plaintiff Janice Cadieux (Janice) in September 1994. Plaintiffs allege that Janice and plaintiffs’ three infant children suffered personal injuries because the water on the property was contaminated with bacteria.
