This is a writ of error brought by Thomas Baldwin, the plaintiff in error, for the review of a judgment of the Circuit Court of the United States for the District of California refusing his discharge, on a writ of habeas corpus, from the custody of the marshal of the district, and the questions' presented for consideration arise on a certificate of the judges, holding the court, of a division of Opinion between them in the progress of the trial.
