This matter is before the court on appeal from the United States Bankruptcy Court for the District of Utah. Oral argument was heard by the court on December 10, 1985. Daniel W. Jackson appeared on behalf of the appellant, Thomas J. Dietz (“Dietz”), and William G. Fowler appeared on behalf of the appellee and trustee, Robert D. Merrill (“Merrill”).
