This adversary proceeding is before the court upon the motion to dismiss filed co-defendants Arturo Lamarche, Juan Mieses and Maxon Engineering Incorporated, S.A. (collectively “Co-defendants”) on February 11, 2009 (Docket No. 196) and the opposition to the motion to dismiss filed by Ms. Noreen Wiscovitch Rentas (“Plaintiff’) on March 5, 2009 (Docket No. 219).
