LAWSON, Justice.

On February 17, 1967, a grand jury of Montgomery County returned an indictment against James Leroy Embrey and Willie Lee Davis for the robbery of J. W. O’Daniel.

Upon his arraignment Embrey pleaded not guilty.

A severance was granted at the request of Embrey and Davis.

Embrey’s trial began on Monday, March 6, 1967, and was concluded on the following day. The jury returned a verdict of guilty and fixed Embrey’s punishment at life imprisonment.
