The plaintiff seeks to recover from the defendants certain sums alleged to be due him because the defendants’ testatrix, for a new consideration given her by the plaintiff in August 1931, guaranteed the payment of, or promised to pay him, the sums due on two promissory notes given by one William F. Spear to the plaintiff and endorsed by the defendants’ testatrix, after maturity, for the purpose above stated. The plaintiff’s declaration contains five counts.
