of the Commission of Appeals, delivered the opinion for the Court.

This is an action in trespass to try title brought by Calder Place Corporation, respondent, against the City of Beaumont, •petitioner. A trial court judgment for respondent was reformed and affirmed by the court of civil appeals. 180 S. W. (2d) 189.

The corporate purpose of respondent was “to erect or repair any building or improvement, and to purchase, sell and subdivide real property in * * cities and their suburbs not extending more than two miles beyond their limits * *, as authorized by Sub-division 47,…
