In this discovery proceeding, the estate seeks to recover from a niece of decedent certain sums of money which the petitioner alleges are the property of the estate and are in the possession of the respondent.

Decedent died on March 31, 1972 at the age of 91. Until October, 1968, she occupied an apartment jointly with her daughter. In that month her daughter died and decedent continued to occupy the apartment alone until August 20, 1970. During that period, she was assisted by various hired people.
