Harold W. Hamblet, Jr. (the “Plaintiff’) commenced the instant action on or about January 20, 2004 with the filing of a Summons and Complaint (the “Complaint”) against Les Brownlee, Acting Secretary of the Army (the “Secretary”), William J. Lennox, the Superintendent of the United States Military Academy (the “Superintendent”), and Leo A.
