•¶1. In this' appeal, we must decide whether the Circuit Court of- Choctaw County erred in dismissing Ottis Cummings Jr/s motion for postconviction collateral relief (PCR).
FACTS AND PROCEDURAL HISTORY
¶ 2. In 1979, Cummings pleaded guilty to burglary of a dwelling and aggravated assault in two separate causes. After serving both sentences, Cummings was convicted in 2009 of felony driving under the influence. See Cummings v. State, 29 So.3d 859, 861 (¶ 6) (Miss. Ct. App. 2010).
