Instructions Nos. 1 and 4, referred to in the opinion, are as follows: “No. 1. The appellant, Frank McNeal, was indicted for the murder of one Will Williams, and convicted of manslaughter, in the circuit court of Winston county. He was sentenced to serve a term of eighteen years in the penitentiary, from which sentence and judgment this appeal is prosecuted. There are a great many errors assigned as cause for reversal, but our view of the case only renders it necessary for us to notice those below mentioned.
