This cause is before the Court on Petitioner’s petition for writ of habeas corpus (Docket No. 1), and Respondent’s motion to dismiss (Docket No. 8).
PROCEDURAL HISTORY
On November 17, 1983, the State Attorney for the Sixth Judicial Circuit, in and for Pinellas Coúnty, Florida, filed an indictment against Petitioner, Michael Irwin. The indictment charged Petitioner with a sexual battery on Anne Marie Irwin, his two and a half year old sister.
