In this ease, Carter E. Scroggin, the owner of a large stock farm situated about seven miles southwest of the City of Decatur, a municipality of about 45,000 population, on the Sangamon Eiver, a natural watercourse flowing along that part of the Scroggin land which was used raising live stock of a.11 kinds, including cattle, mules, horses and sheep, commenced this suit to recover damages for the injuries to his cattle, horses, mules and sheep, by the pollution of the waters of the Sangamon Eiver, by the City of Decatur, which emptied its sewage into the river through its sewerage system.…
