United States v. Charles v. Leake

Court of Appeals for the Sixth Circuit

Decided September 28, 1993No. 92-6070PublishedCited by 161 opinions

1Opinion of the Court

RYAN, Circuit Judge.

The government appeals from the district court’s order suppressing evidence in this drug trafficking prosecution. The government. raises two issues:(1) Whether the district court erred in finding the state magistrate was not shown that there was probable cause to justify issuance of the search warrant; and

2) Whether, if the warrant was issued without probable cause, the executing officers nevertheless reasonably relied on the warrant in good faith.

Finding no error in the district court’s disposition of these issues, we shall affirm.
