1. The defendant, plaintiff in error here (hereinafter referred to as the defendant), contends that the petition did not set forth a cause of action because, while it alleged that the trial court had jurisdiction, the facts set forth contradicted this allegation and revealed that as a matter of law the court was without jurisdiction of the defendant; that it was apparent from the petition that the proper venue of the case was in Lamar County and not in Bibb County.
