This is a motion by the defendant for summary judgment in its favor. .

The action is against an insurance brokerage corporation for damages of $109,-674.13 for breach of warranties alleged to have been made by the defendant in connection with the placing of certain insurance for the plaintiff with an insurance company. In a prior action against the insurance company on the insurance policy, the plaintiff failed to recover solely because it had no insurable interest in the subject matter of the insurance.
