Court of Claims jurisdiction; torts; mandatory injunction. — On January 18, 1974 the court issued the following order:
“This case comes before the court on defendant’s motion to dismiss plaintiff’s petition on the ground that the court lacks jurisdiction of the claim and that the petition fails to state a claim upon which relief can be granted.
