DUFFY, Chief Judge.
Defendant Insurance Company issued a policy of motor vehicle liability insurance to one Harry Fox of Fort Wayne) Indiana, covering a 1947 Mack Truck for a period of 12 calendar months from February 13, 1952. The policy covered Fox and any person using or any organization legally responsible for the use of said truck. On September 19, 1952, while the truck was being operated by an employee of plaintiff, with the permission 0f Fox, it was involved in a collision on a highway in the state of Ohio, and one Pickering was killed.
