Appeal from a judgment of the Supreme Court (Harris, J.), entered October 21, 1996 in Albany County, which dismissed petitioner’s application, in a proceeding pursuant to Election Law § 16-104, to declare valid the amended certificate of nomination placing petitioner’s name before the name of respondent Kevin M. Dillon as the Democratic Party candidates for the office of Supreme Court Justice for the Eighth Judicial District in the November 5, 1996 general election.
