This is an action that was brought originally for specific performance of a contract for the purchase and sale of real estate, as well as for consequential damages caused as a result of the alleged failure of the defendant to convey the property when promised, in accordance with a written “offer and acceptance” signed by the parties. This lawsuit was filed on July 27, 2001, approximately two weeks following the closing date set in the “contract.” While the parties, thereafter, in May 2002, carried out the conveyance of the real estate as bargained for, the case continued upon the plaintiffs…
