This is an appeal from a judgment in favor of the administrator of the estate of Martha E. Eickner.

Martha E. Eickner died intestate in April, 1970. On December 26, 1972, John A. Eickner, petitioner and respondent :and the husband of deceased (hereinafter referred to as Eickner) petitioned for letters of administration.
