This is a petition for writ of certiorari to the Circuit Court of Pinellas County, Florida. The petition alleges, among other things, that the petitioner obtained a judgment by default against the defendant, Boulevard and Bay Land and Development Company, for want of pleas, on February 1, 1926. On May 13, 1926, the petitioner, plaintiff in said suit, filed his praecvpe with the clerk of said court for final judgment and filed proof of claim, and final judgment was entered by the clerk upon the declaration and proof of claim.
