This case was tried upon the second paragraph of the complaint of John E. Smith against the appellants, which is as follows:

“ Eor further cause of action against said defendants* plaintiff says that said defendants were, in the month of July, 1874, partners, under the style of The Indianapolis Trotting Association, and, as such partners, offered certain premiums for a trotting match, to he held at Indianapolis on or about the 11th day of July, 1874, as follows, to wit: To the owner of the five-year-old horse which should make the best time in said trotting match, a premium of five hundred…
