Appeal from a judgment of the County Court of Albany County (Herrick, J.), rendered April 1, 2009, upon a verdict convicting defendant of the crime of criminal sale of a controlled substance in the third degree.

Following a February 2007 controlled buy of cocaine from de*1184fendant in the City of Albany, defendant was indicted and charged in October 2008 with one count of criminal sale of a controlled substance in the third degree.
