This case arose > over a claimed certificate of membership in Security Benefit Association of Topeka, Kansas, of Hans Maryan Bukowski; the certificate being in the sum of $2,000, of which the plaintiff herein was beneficiary. At the close of the testimony, a motion for a directed verdict was made by the plaintiff, and a like motion was made by the defendant. The court sustained the defendant’s motion and entered judgment for defendant. The opinion in this court reversing the lower court is reported in 261 N.
