DAUGHERTY, Chief Judge.

The petitioner, a prisoner in the Oklahoma State Penitentiary at McAIester, Oklahoma, has filed herein his Application for a Writ of Habeas Corpus in which he challenges the validity of the judgment and sentence of the District Court of Tulsa County, State of Oklahoma, Case No. CRF-69-1867. He alleges that he is entitled to relief on three grounds:

1. The fruits of a constitutionally invalid search were received in evidence at his trial;
