MilleR, Judge:

It appears from the record in this case that, on the 1st. day o£ March, 1898, the appellant, D. W. Gall, sold to appellee, John T. Reger, the “Plaindealer,” a newspaper plant in the town of Philippi, Barbour County, West Virginia, for one thousand dollars. Reger executed to Gall his seven several promissory notes for said sum — rare for fifty dollars, payable October 30, 1898, five for one hundred and fifty dollars each, payable October 30, 1899, 1900, 1901, 1902, and 1903, respectively, and one for two hundred dollars, payable October 30, 1904, all bearing date on the day and…
