The town of Beacon Falls and its zoning and planning commission brought this action against the defendant landowner seeking a penalty under a town ordinance, and an injunction under its zoning regulations and the general statutes because of his operation of a bulky waste disposal area1 pursuant to *19a permit issued by the department of environmental protection (DEP). The defendant has appealed from the judgment of the trial court in favor of the plaintiffs. We find error.
