Tbe defendants, Hogan, Whitfield, Watson and Colwell, were indicted for secret assault upon Everett Hamilton, by dynamiting tbe bouse, where Hamilton and bis family were sleeping, on tbe night of 12 June, 1910. They were all found guilty, and all but Colwell appealed.
Tbe first assignment of error that tbe evidence was not sufficient to be submitted to tbe jury could not be considered, unless there was a prayer to that effect, presented at tbe close of tbe evidence.
