Appeal from circuit court McPherson county. PIon. Losing E. Garry, Judge. Action on a fire policy by John F. Wilson against the Commercial Union Insurance Company. From a judgment in favor of the plaintiff, the defendant appeals.

This is an action on a policy of insurance. The case was tried to a jury, and a judgment rendered in favor of the plaintiff, and the defendant appeals. The plaintiff states in his complaint, in substance; (i) That the defendant was a corporation ; (2) that the plaintiff was the owner of a stock of merchandise of the value of $2,133; (3) that the defendant insured the same against loss by fire to the amount of $800; (4) that the property was destroyed by fire July 5, 1898, and that the value at the time of such fire was $2,133; (5) that the plaintff’s loss thereby was the amount above…
