CHRISTIAN, Judge.

The offense is theft of property over the value of $50; the punishment, confinement in the penitentiary for two years.

The property alleged to have been stolen was 2,500 pounds of Sudan grass seed of the value of $250. C. M. Forbus testified that.he lost 35 sacks of Sudan seed from his premises on the night of April 16, 1935. He testified, further, that said seed weighed 3,500 pounds. Said property was never recovered by him. According to the testimony of the State, shortly after the alleged theft appellant sold 35 sacks of Sudan seed in Fort Worth. There was testimony to the…
