The following statement is to be considered in lieu of findings of fact and conclusions of law.

Prior to the events here related W. C. Weaver died intestate in 1929, leaving surviving his widow and three children, including the defendant, P. F. Weaver. At the time of his death he was the owner of certain real estate in Greensville County, Virginia, which passed to his heirs at law.
