KNOLL, Judge.

The Village of Maurice (hereafter Village) appeals an adverse judgment dismissing its petitory action against Harris and Brenda Desormeaux (hereafter Desor-meauxes) on a motion for summary judgment. The Village initiated a petitory action against the Desormeauxes asserting ownership of a tract of land donated to the Village in 1922 for use as a public street. The Village never physically possessed the tract, and the Desormeauxes asserted ownership of it by 30 years acquisitive prescription.
