The above matter is brought before this court on an appeal taken by the defendant-appellant from a decision rendered by Verner M. Ingram, Justice of the Peace of the town of Potsdam, St. Lawrence County, New York. In the lower court the defendant-appellant was found guilty of a traffic infraction of speeding, pursuant to the provisions of subdivision 3 of section 56 of the Vehicle and Traffic Law.

On August 25, 1949, on information from two deputy sheriff's of the County of St. Lawrence, said defendant-appellant was duly arrested and arraigned in Justice’s Court on the above-mentioned charge.…
