Roscoe Pickett, Ralph E. Marler, and *422Leon Paine, Jr., (appellees) brought an equitable action in Cobb Superior Court against Chamblee Construction Co., Inc., (appellant) and Henry L. Williams, Clerk of the Civil Court of Cobb County.
