On a writ of error to the Court of Common Pleas of Mlegheny county, the proceedings in this suit were brought up to this court, and were as follows.

The opinion of the court, (Tilghman, C. J. being absent,) was delivered by

Duncan, J.

This was an appeal from a judgment of a justice of the peace in favour of the .defendant in error, 94 dollars and 9 cents in debt. The process of the justice was for demand and damage for one-third of a Fuller’s book, not exceeding 100 dollars.

The declaration in the Common Pleas was in account render. The arbitrators awarded in favour of the defendant in error, plaintiff below, 85 dollars and 57 cents. From the return of the justice it would appear, that account render was the proper form of action in which…
