Appeal by the plaintiff, William Bradley, from an order of the Supreme Court, made at the Rew York Special Term and entered in the office of the clerk of the county of Rew York on the 2d day of August, 1901, denying the plaintiff’s motion for an injunction pendente lite and dissolving a preliminary injunction theretofore granted.

Ingraham, J.:
The plaintiff, a taxpayer in the city of Rew York, brings this action to restrain the board of estimate and apportionment from accepting a bid for the construction of a public library and the commissioner of parks from executing a contract therefor, and to restrain the comptroller of the city of Rew York from taking any action toward the selection of a bidder therefor or paying out any money of said city under any selection, award or contract therefor.
