Tbis appeal presents tbe question of tbe liability of tbe defendant American Express Company upon certain travelers’ cheques issued by it, wbieb came into tbe possession of tbe plaintiff and were presented for payment without signature or countersignature of tbe purchaser.
Tbe pertinent facts, as shown by tbe evidence adduced in tbe trial below, may be stated as follows: Tbe defendant American Express Company, prior to December, 1926, sent to tbe Charlotte Bank & Trust Company for sale to its customers numbers of printed travelers’ cheques bearing only tbe signature of defendant’s treasurer.…
