KRUEGER, Judge. —

The appellant was tried and convicted of the offense of transporting motor fuel and gasoline under a false billing and manifest, and his punishment assessed at a fine of $250.

By motion to quash and by a motion in arrest of judgment, the appellant questioned the sufficiency of the indictment, which, omitting the formal parts, reads as follows: “That on or about the 5th day of May, A. D., 1933, and anterior to the presentment of this indictment, in the County and State aforesaid, H. E. Worbes did then and there unlawfully and knowingly transport motor fuel and gasoline upon…
