Plaintiff Compania Embotelladora Del Pacifico, S.A. (“CEPSA”) filed the above-captioned action against defendant Pepsi Cola Company (“PepsiCo”) on October 11, 2000, seeking damages for PepsiCo’s alleged breach of an Exclusive Bottler Appointment Agreement (“EBA” or “Agreement”) that appointed CEPSA as PepsiCo’s exclusive bottler for certain parts of Peru.
