This is the second appearance of this case in this court. The trial court sustained a general demurrer to the plaintiff’s petition, and this court reversed that judgment. Baker v. Augusta Veneer Co., 44 Ga. App. 383 (161 S. E. 676). While the evidence introduced on the trial of the ease was conflicting, the plaintiff introduced evidence tending to establish the allegations of his petition. After the jury had considered the case for about' nineteen hours, they reported that they were unable to agree and were divided on a question of fact. The court then recharged the jury as follows:…
