AMENDED DECISION ON MOTION TO DISMISS AND FOR SUMMARY JUDGMENT

Not too long ago, Comp VI, Inc. (“Comp VI”), the New York City franchisee of Computerland Corporation (“Computer-land”), telephoned Computerland with the news that Comp VI would be filing a chapter 11 petition the following day. Forewarned, Computerland terminated the franchise before the day was out. At issue are the propriety and validity of that pre-filing termination.
