The principal issue we are asked to consider on this appeal is whether a sentencing court may delegate its sentencing authority to the United States Probation Department1 to determine whether a defendant should undergo inpatient or outpatient drug treatment as a special condition of supervised release. Here, the District Court (Irizarry, J.) imposed a special condition of supervised release that delegated the discretion to select between inpatient and outpatient treatment to the Probation Department.
