delivered the opinion of the court.

The plaintiff, Jacob Sturm, recovered a verdict against the Consolidated Coal Company, defendant, in the circuit court of Macoupin county for the sum of $5,000 as damages for personal injuries alleged to have been sustained by the negligence of the defendant. The plaintiff entered a remittitur of one-half of the verdict and judgment was entered against. the defendant for $2,500, from which judgment this appeal is prosecuted.
